Milimani Law Court Senior Principal Magistrate Bernard Ochoi on the 29th of August 2023, acquitted the Member of Parliament of Embakasi East Honorable Babu Owino, of misuse of fire arm charges following the shooting of DJ Evolve (Felix Orinda) at B Club in Nairobi’s Kilimani area on the 17th January, 2020. This acquittance was a significant victory for Babu Owino, who has been fighting these charges for over two years but on the prosecution side it is a setback being unable to secure a conviction in the case.
Delivering the verdict, Magistrate Bernard Ochoi ruled that the prosecution had failed to provide sufficient evidence proving that Babu Owino was the one who shot DJ Evolve. The Magistrate added that, the prosecution did not have medical reports to prove that DJ Evolve was shot and the ballistics reports did not link the bullet that injured DJ Evolve came from Babu Owino’s gun. During the trial, DJ Evolve himself testified that he did not see Babu Owino shoot him and that he was shot by someone he did not know. Based on this evidence, the court found Owino not guilty of the charges against him.
The case which since its start has been closely watched by Kenyans and people across the globe, has some people believing that Babu Owino is innocent, while others believe that he is guilty and he is getting away with a crime. In the midst of this news, Babu Owino come out and said that he will not celebrate his acquittal until DJ Evolve fully recovers. In a statement, Babu Owino assured the public that he will walk side by side with DJ Evolve on his road to recovery and he further added that he is planning to take DJ Evolve to India for further treatment and he prays that DJ Evolve will walk again in the near future. DJ Evolve is still recovering from the injuries he sustained in the shooting. He is currently wheelchair-bound and has limited mobility.
